On Monday, Xavier’s Law was slated for royal assent during the fall session of the legislature, but now it’s in jeopardy of being passed due to the called election. “We learned quite quickly that when you call an election that things get dissolved,” says Xavier’s father, Josh Jankovic. “The family’s reaction right away is we’re back to square one.” On Aug. 25, 2025, 12-year-old Xavier Rasul-Jankovic was struck and killed by an alleged dangerous driver while rollerblading with his brother and father. “Something needs to change, and that’s all we’re doing,” says Jankovic. Xavier’s Law would give police the authority to issue a 30-day roadside driving ban for reckless driving on the spot. But now the family will have to start over. “This is a bipartisan, mutually agreed-upon landslide vote in the legislature, to be passed. So, of course, we’re disappointed,” added Jankovic. BC NDP candidate and incumbent for the Juan de Fuca-Malahat riding Dana Lajeunesse, who was instrumental in getting Xavier’s Law down to the finish line, says in a statement: “Introducing Xavier’s Law is one of the things I’m most proud of from my time as MLA. After meeting with Xavier’s family and hearing their heartbreaking story.” Lajeunesse added that if elected, he would reintroduce Xavier’s Law at the earliest opportunity and get it passed into law as quickly as possible. Both the BC Greens candidate David Evans and BC Conservative candidate Mike Hicks for the Juan de Fuca-Malahat riding told CTV News they also support getting Xavier’s Law passed. “It is really a shame that whoever comes in to be the MLA next time will have to start from scratch. I will absolutely work across parties to bring back the spirit of Xavier’s Law,” says Evans. “It’s one of my constituents and is a valid law. I’d be happy to take it on if I’m elected and take it through the course,” says Hicks. Regardless of the election outcome, Xavier’s family says it will continue fighting to get the law passed and dangerous drivers off the road. “We’re not going to stop until we get this done,” says Jankovic.
